Your submission of information, including personal information, through or in connection with the novalink Services is governed by the terms of the Anomaly Privacy Policy as updated from time to time, available at https://connectnova.link/privacy (“Privacy Policy”). To access or use the novalink Services, you will be required to first accept the Privacy Policy. You will be prompted to accept the Privacy Policy upon your initial registration of an account (“Account”) by clicking to accept. You will also be prompted to accept updates to the Privacy Policy from time to time when you log in to your Account by clicking to accept the updated Privacy Policy.

When you accept the Privacy Policy and any updates thereto, you consent to us collecting, accessing, using, processing, and retaining any personal information you provide to us so we may provide the novalink Services to you. 1.1 Wallet Creation

The Wallet is a web-based smart wallet that runs on mobile and desktop platforms. It provides users with access to an interface that allows them to execute instructions directly on a variety of Ethereum-compatible blockchain networks (“Supported Blockchain Networks”). The Wallet allows users to view balances for digital assets compatible with the Wallet (“Blockchain Assets”), initiate transfers and transactions involving Blockchain Assets, and interact with decentralized applications (collectively "Dapps"), including, but not limited to, decentralized exchanges. Transactions may include peer-to-peer swaps of Blockchain Assets (“Swaps”) and bridging Blockchain Assets from one Supported Blockchain Network to another (“Bridges”).

To create an Account and open a Wallet, users must provide an email address or user ID associated with supported services (e.g., Google, Facebook, Reddit, Discord, or similar platforms) (“Login Credentials”). If the user has not reached the legal age of majority but is at least thirteen (13) years old, the user’s parent or legal guardian must register a Wallet on the user’s behalf.

When you use the novalink Services, you may also be utilizing third-party services (“Third-Party Services”). These Third-Party Services will be governed by their own privacy policies, terms of use, and associated costs.

 

1.2 Wallet Access

The Wallet is web-based software secured by a “private key” system. If you lose access to your device, you can still access your Wallet using your Login Credentials and the private key maintained by us. Similarly, if you lose your Login Credentials, you can access your Wallet using your device and the private key maintained by Anomaly.

Blockchain Assets accessible through the Wallet are controlled solely by you, and Anomaly does not have custody or ability to transfer these assets. Only you can authorize transactions or transfers of your Blockchain Assets. By using the Wallet, you understand and accept the following risks:

(a) Security Risks: While Anomaly has implemented robust security measures, wallets are subject to exploits. Users accept all security-related risks, including potential loss of funds due to exploits or system vulnerabilities.

(b) Responsibility for Credentials: You are responsible for keeping your Login Credentials and device secure. Unauthorized access due to negligence may lead to irreversible losses.

(c) Asset Value Fluctuations: The value of Blockchain Assets can fluctuate, posing a risk of loss. Anomaly does not offer guarantees regarding value or pricing.

(d) Blockchain Technology Risks: Using Blockchain Assets involves inherent risks, including network congestion, hard forks, or vulnerabilities in blockchain networks or smart contracts. Blockchain transactions are often irreversible.

(e) Tax Obligations: You are solely responsible for determining tax implications and fulfilling any tax obligations related to your Blockchain Asset transactions.

(f) Service Changes: Anomaly reserves the right to modify or discontinue Wallet support at any time, without notice.

(g) Fork Disruptions: Blockchain network changes, such as forks, may result in unsupported Blockchain Assets. During such events, transaction disruptions may occur.

 

1.3 Fees

You may be charged fees for certain novalink Services, such as transactions within Third-Party Dapps (e.g., Swaps or Bridges). Anomaly reserves the right to adjust these fees. Additionally, blockchain network transaction fees will apply to all transactions. You must also comply with and pay any fees associated with Third-Party Services.

Although we strive to provide accurate fee estimates and pricing information, Anomaly is not liable for discrepancies between estimated and actual amounts due to evolving blockchain technologies.

 

1.4 Third-Party Services

novalink may integrate or link to Third-Party Services. While these services may enable features like Swaps or Bridges, Anomaly does not control or endorse Third-Party Services. You assume all risks associated with utilizing them.

 

1.5 Disclaimers

Anomaly does not facilitate Blockchain Asset exchanges or financial advice. Transactions using the novalink Wallet occur directly between users via public blockchains. Anomaly disclaims responsibility for third-party services, asset performance, or network reliability.

 

2. User Representations

By using the novalink Wallet, you confirm:

  1. You comply with laws in your jurisdiction and have the legal right to own and manage Blockchain Assets.
  2. You are not listed on any sanctions list from Canada, the United States, or any other relevant jurisdictions.
  3. You will not create false accounts, disrupt Wallet functionality, or exploit the system.

 

3. Website Access

3.1 License and Restrictions

Anomaly grants you a limited, non-transferable license to access the novalink Website. Any unauthorized use, commercial exploitation, or modification of the Website is strictly prohibited.

 

3.2 Website Updates and Information Accuracy

Anomaly reserves the right to suspend or modify the Website at any time without notice. While we aim to provide accurate and current information, errors or inaccuracies may occur.

 

4. Disclaimer of Warranties

novalink Services are provided “as-is” without any warranties, express or implied. Neither we nor our service providers guarantee uninterrupted, virus-free operation. Jurisdictional limitations may apply.

 

5. Termination of Services

Anomaly may suspend access to the Wallet for violations of these terms. Any such action will not interfere with your ability to transfer or access Blockchain Assets.

 

6. Indemnity

You agree to indemnify Anomaly against claims arising from your use of the Wallet or any violations of these Terms.

 

7. Limitation of Liability

Anomaly’s total liability for claims related to these terms shall not exceed USD $50. Jurisdiction-specific exceptions may apply.

 

8. Dispute Resolution

All disputes will first be attempted to be resolved through mediation. Unresolved disputes will proceed to binding arbitration in accordance with the laws of Ontario, Canada, unless prohibited in your jurisdiction.

 

9. Changes to these Terms

Anomaly reserves the right to update these terms. Changes will take effect when accepted upon your next interaction with the Wallet Services.
